Legal Consultation Member Benefit

ASBO New York provides (i) Individual (SBO) Members, (ii) those Institutional Package Members with the privileges of Individual (SBO) Members, and (iii) any other member who is in the process of becoming appointed as an SBO and will, as a result, become a member of the type referenced in (i) and (ii) (collectively, “Eligible Member(s)”) in good standing with access to up to 3-hours of legal services per membership cycle year for legal matters related to the Eligible Member’s employment relationship with their school, school district, or BOCES.  

ASBO New York offers this Benefit through participating counsel to help Eligible Members protect their interests in major career moments, such as employment, termination, retirement, and benefit negotiation.  

The Benefit is only available for matters related to an Eligible Member’s employment. Eligible Members most typically utilize the Benefit for legal guidance and contract review related to commencing, ceasing, or changing the nature of their employment.  

Access to the Benefit is not available for:

• Collective bargaining representation
• Matters covered by union representation
• Personnel management and human relations decisions
• Actions covered under Public Officers Laws
• Criminal actions
• Defense against actions of the community and other matters for which a Member is indemnified
• Matters of a personal nature that are not directly related to Member’s employment

If a request for legal assistance places ASBO New York in a position where the interests of two or more Members of ASBO New York are in conflict, ASBO New York reserves the right to not approve the request for access to the Benefit.

The Benefit shall be available to Eligible Members in good standing without regard to characteristics protected by law.

The Benefit is gratuitous, subject to amendment, and revocable at any time, at ASBO New York’s complete and sole discretion. No Member shall rely on access to this Benefit, now or in the future.
